What HeroMark is
HeroMark is a trademark monitoring service that checks the USPTO public database for new filings that may conflict with your brand name. It is a research and alerting tool only. Nothing on this platform constitutes legal advice. Always consult a licensed trademark attorney before taking legal action.
Your account
You are responsible for keeping your account credentials secure. You may not share your account with others. You must provide accurate information when signing up. We reserve the right to suspend accounts that violate these terms.
Subscriptions and billing
Paid plans are billed monthly or annually in advance. You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period — no prorated refunds. We reserve the right to change pricing with 30 days’ notice.
Limitations
HeroMark monitors the USPTO database and may not capture all trademark activity. We do not monitor state-level trademarks, common law trademark rights, or trademark databases outside the United States. Alerts are based on automated similarity scoring and may miss some conflicts or flag false positives. Use this service as one input, not your only defense.
Limitation of liability
HeroMark is provided “as is.” We are not liable for any damages arising from your use of, or inability to use, the service — including any trademark conflicts that occur while you are a subscriber. Our total liability to you will not exceed the amount you paid us in the 12 months prior to the claim.
